Terms & Conditions

Effective 7 September 2026 · Last updated 7 September 2026

1. Who you are contracting with

Diwan POS is supplied by Hamza Waheed, an individual sole proprietor trading as “Diwan”, based in Pakistan. Diwan is not a registered company; your contract is with Hamza Waheed personally, in his capacity as a sole proprietor. In these terms, “we”, “us” and “our” mean that sole proprietorship, and “you” means the person or business buying a licence.

2. Acceptance

By creating an account, buying a licence, or installing or using Diwan POS, you agree to these terms. If you do not agree to them, do not buy or use the software.

If you are agreeing on behalf of a business, you confirm you are authorised to bind that business.

3. Definitions

  • Software — the Diwan POS application for Windows, macOS, Linux or Android, including any updates we supply.
  • Licence key — the unique code issued to you on purchase that permits use of the Software.
  • Terminal — one device running the Software.
  • Branch — one physical trading location.

4. Licence grant

On payment in full, we grant you a non-exclusive, non-transferable licence to install and use the Software for your own business purposes, subject to these terms and to the limits of the edition you bought:

Starter — Rs 8,000 1 terminal, 1 branch.
Standard — Rs 12,000 Up to 3 terminals, 1 branch.
Enterprise — Rs 25,000 Unlimited terminals, multiple branches.

Each licence key activates on exactly one device. The key binds permanently to the first device it is activated on, and cannot be activated on a second device. Where your edition permits more than one terminal, you receive a correspondingly licensed number of activations — contact us to arrange them.

If you replace a device, we will move your licence for you on request. See our Service Delivery Policy. We may ask you to verify your purchase before we do so.

Your licence does not expire. It is a one-time purchase with no renewal date, no subscription, and no requirement to pay again to keep using the version you bought.

5. What you may not do

You may not:

  • Share, resell, sublicense, rent, lend or publish your licence key;
  • Use one licence key across more devices or branches than your edition allows;
  • Reverse engineer, decompile or disassemble the Software, except to the extent that law expressly permits it despite this restriction;
  • Circumvent, disable or tamper with licence activation, or attempt to generate or forge licence keys;
  • Remove or alter any copyright or ownership notices in the Software;
  • Use the Software for anything unlawful, or to record transactions you know to be fraudulent.

We may revoke a licence, without refund, if you materially breach this section.

6. Your account

You are responsible for keeping your password and licence key confidential, and for everything done through your account. Tell us promptly if you believe your account or key has been compromised.

You must give us an email address you actually control. Your licence key is delivered to it, and it is how we identify you for support and refunds.

7. Payment

  • Prices are shown on our pricing page and in the product catalogue, in Pakistani Rupees.
  • Licences are sold as a one-time purchase. There is no recurring subscription and we will not automatically charge you again.
  • Payment is taken through a third-party payment processor. We do not receive or store your card details.
  • The price you pay is the price displayed at the time of purchase. We read the price from our own records when creating your order; a price displayed incorrectly in your browser is not binding.
  • Any taxes or duties applicable to you are your responsibility unless we state otherwise.
  • Any fees your own bank charges you — for currency conversion or otherwise — are yours to bear.

8. Refunds

A full refund is available within 14 days of purchase provided your licence key has not been activated. Refunded licences are revoked and stop working. Our Refund Policy sets out the full terms and takes precedence over this summary.

9. Delivery, updates and support

The Software is delivered electronically on payment. Our Service Delivery Policy describes how, how quickly, and what to do if delivery fails.

Software updates are included free of charge. There is no separate update fee and no subscription. We do not undertake to release updates to any timetable, but where we do publish them they are available to you at no extra cost, using the licence key you already hold.

Support is provided by email for all editions, and additionally by phone for Enterprise. We aim to respond within 1 business day. Support covers installation, activation, and defects in the Software. It does not cover training, your hardware, your network, or third-party software.

10. Intellectual property

The Software, its source code, design, branding and documentation remain our property. Buying a licence buys you the right to use the Software; it does not transfer ownership of it or of any intellectual property in it.

“Diwan” and the Diwan logo are our marks. You may not use them to promote your own products or to imply we endorse you.

11. Your business data and backups

Your trading data is yours, and it lives on your device. Diwan is offline-first: your sales, stock, customer and pricing data are stored locally and are not uploaded to us. We do not have access to them and cannot recover them for you.

Taking backups is your responsibility. If your device fails or is lost, your data goes with it unless you have backed it up.

12. Warranty disclaimer

The Software is provided “as is”. We do not warrant that it will be uninterrupted, error-free, or fit for any particular purpose beyond what is described on this website, nor that it will be compatible with every configuration of hardware, printer or operating system.

Nothing in this section excludes any warranty or right that cannot lawfully be excluded.

13. Limitation of liability

Our total liability to you, for all claims combined, is limited to the amount you actually paid us for your licence.

We are not liable for:

  • Lost sales, lost profit, lost revenue or business interruption — including where your counter is unable to trade;
  • Loss or corruption of your business data;
  • Indirect or consequential loss of any kind;
  • Failures caused by your hardware, your internet connection, your printers, your operating system, or third-party software;
  • Anything outside our reasonable control.

Point-of-sale software sits in the middle of your trading. We have written these limits plainly rather than burying them, because they matter: please keep a way to take payment if Diwan is unavailable, and keep backups.

Nothing here limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited.

14. Termination

We may suspend or terminate your licence if:

  • You materially breach these terms, in particular section 5;
  • Your payment is reversed, charged back or refunded;
  • We are required to do so by law.

Where the breach can be put right, we will normally tell you and give you a reasonable chance to fix it before terminating. On termination, your licence is revoked and you must stop using and remove the Software. Termination for breach does not entitle you to a refund.

You may stop using Diwan at any time. Doing so does not by itself entitle you to a refund outside the Refund Policy.

15. Changes to these terms

We may update these terms. The “last updated” date at the top will change, and material changes will be emailed to account holders before taking effect. Changes do not apply retrospectively to a licence you have already bought, except where required by law.

16. Governing law and jurisdiction

These terms, and any dispute arising out of them or out of your use of the Software, are governed by the laws of the Islamic Republic of Pakistan.

The courts at Islamabad, Pakistan have exclusive jurisdiction over any such dispute.

Nothing in this section removes any right you have under Pakistani consumer protection law.

17. General

  • Severability — if any provision is found unenforceable, the rest continues in force.
  • No waiver — if we do not enforce a term straight away, we do not lose the right to enforce it later.
  • Entire agreement — these terms, together with our Privacy, Refund and Service Delivery policies, are the whole agreement between us about the Software.
  • Assignment — you may not transfer your licence or your rights under these terms to anyone else without our written consent.
